The Fair Labor Standards Act (FLSA) and the Massachusetts Wage Act (MWA) establish minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. This session will review the basic requirements of the FLSA and MWA, including:
- The legal definition of independent contractors vs. regular employees
- Differences between exempt and non-exempt employees
- How to determine what activities count as work for time reporting purposes, even for situations like: travel time, on-call time, work from home, break time, time reporting, and overtime pay
About the Presenter
After practicing for several years at one of Boston’s largest law firms alongside retired Williams College Counsel Jeff Jones, Kevin returned to his home in the Berkshires in 1994. He has two decades’ worth of experience in representing schools, colleges, businesses and individuals. Kevin’s work in state and federal courts and his successful advocacy before arbitrators and administrative agencies have resulted in outstanding awards and judgments for his clients. His cases have been profiled in national and international legal publications and newspapers.
Kevin advises educational institutions and businesses as counsel on a broad range of legal issues. He regularly conducts independent investigations for colleges, universities and private secondary schools. Academic institutions who need a qualified and unbiased investigator in Title IX and other matters regularly retain Kevin to conduct a thorough and fair investigative process.
He has aided a wide variety of clients in employment law – his primary area of practice – including the preparation of employee handbooks and policy manuals, employment agreements, separation agreements and hiring documents. Kevin is dedicated to protecting employers and assists businesses in trade secret protection, wage and hour issues, disability accommodation, maternity leave law compliance, insurance coverage, workplace privacy, electronic monitoring and employee evaluation.
